Scope & Acceptance

By accessing this website, placing an order, submitting an inquiry, or engaging with our content, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions in their entirety and without reservation.

Nature of the Website & Commercial Scope

Santo de Piedra operates as a curatorial maison, conceiving limited collections rather than mass-produced goods. Nothing on this website constitutes an offer capable of acceptance; all orders are subject to acceptance and confirmation by Santo de Piedra at its sole discretion.

E-commerce Operations

Santo de Piedra is solely responsible for transactions executed directly through its official e-commerce platform on this website. Only such transactions constitute a direct commercial relationship with Santo de Piedra.

 Third-Party Commercial Operations

Any other sales, offers, allocations, resales, imports, exports, distribution, or commercial activities involving Santo de Piedra products, including those conducted by:

  • importers,

  • distributors,

  • retailers,

  • hospitality venues,

  • collectors,

  • private clients,

  • or other third parties,

are conducted independently and outside the scope of Santo de Piedra's direct responsibility, whether or not such third parties have been formally appointed, recommended, or previously collaborated with Santo de Piedra. Santo de Piedra makes no representation or warranty as to the authenticity, condition, or provenance of products sold by third parties.

Santo de Piedra shall not be deemed a party to, nor responsible for, such third-party transactions, and accepts no liability arising from them.

Eligibility & Legal Compliance

You confirm that:

  • You are of legal drinking age in your country of residence.

  • You are legally permitted to purchase and receive alcoholic beverages under applicable laws.

  • You assume full and sole responsibility for compliance with customs, importation, taxation, and alcohol regulations in your jurisdiction.

We reserve the right to refuse service, cancel any order, or terminate access to the website, at our sole discretion and without liability, where we suspect non-compliance with this Section or with applicable law.

Responsible Marketing

In accordance with French law (Loi Évin) and applicable EU regulations, all content on this website is presented for informational and commercial purposes to persons of legal drinking age only. Nothing on this website shall be construed as encouraging excessive consumption, consumption by minors, or consumption in a manner harmful to health.

Pricing, Orders & Payment

  • Prices are displayed in EUR unless otherwise stated, and are indicative until confirmed at checkout.

  • Prices include applicable French VAT only where legally required; other applicable taxes remain the customer's responsibility.

  • Shipping costs, customs duties, import taxes, or local charges may be excluded unless explicitly stated, and shall be borne by the customer.

  • Santo de Piedra reserves the right to modify prices at any time prior to order confirmation.

We reserve the right to correct errors (including pricing or descriptive errors), cancel orders, limit quantities, or refuse transactions at our sole discretion and without liability, including after an order has been placed.

Logistics, Shipping & Third-Party Carriers

 Use of Third-Party Logistics Providers

All shipping, transportation, handling, and delivery services are performed by independent third-party carriers and logistics providers, acting as independent contractors.

Santo de Piedra does not operate, control, or supervise these logistics services and makes no warranty regarding their performance.

 Risk & Responsibility

Unless otherwise required by mandatory French or EU law:

  • Risk of loss or damage transfers to the customer upon handover of the goods to the carrier.

  • Delivery times are indicative only and not guaranteed; Santo de Piedra shall bear no liability for delay.

  • Santo de Piedra shall not be liable for delays, losses, damages, seizures, confiscations, or failures caused by carriers, customs authorities, insurers, or regulatory bodies.

Any claims related to shipping or transport shall be directed primarily to the carrier or relevant third party, and the customer waives, to the fullest extent permitted by law, any direct claim against Santo de Piedra in connection with carrier performance.

 

Returns, Cancellations & Non-Conformity

Due to the bespoke, limited, and collectible nature of our products, and in accordance with Article L221-28 of the French Code de la consommation, the right of withdrawal does not apply to goods made to the consumer's specifications, clearly personalized, or liable to deteriorate or expire rapidly, to the fullest extent such exclusion is available under applicable law.

Where a right of withdrawal does apply under mandatory law:

  • Any damage or non-conformity must be reported within 48 hours of receipt, with photographic evidence and appropriate documentation, failing which the goods shall be deemed accepted in conforming condition.

  • Returned goods must be unopened, unused, and in their original packaging.

This Section does not affect mandatory, non-waivable consumer rights under the French Code de la consommation or applicable EU law, which shall prevail in case of conflict.

 

Intellectual Property

All content on this website — including trademarks, trade names, designs, images, text, and product presentations — is the exclusive property of Santo de Piedra or its licensors and is protected under the French Code de la propriété intellectuelle and applicable international treaties.

No content may be used, reproduced, distributed, modified, or exploited in any form without the prior written consent of Santo de Piedra. Any unauthorized use may be subject to civil and criminal prosecution, and Santo de Piedra reserves the right to pursue all available remedies, including injunctive relief, without prior notice.

 

Confidentiality & Discretion

Confidential Information

Any non-public information disclosed through this website or through direct communication — including private allocations, pricing structures, unreleased collections, research initiatives, and client relationships — is considered confidential and constitutes the proprietary information of Santo de Piedra.

Obligations

You agree to:

  • Maintain strict confidentiality,

  • Use such information solely for its intended purpose,

  • Not disclose it to third parties without the prior written consent of Santo de Piedra.

Breach of this Section shall entitle Santo de Piedra to seek injunctive relief in addition to damages, without the need to demonstrate irreparable harm.

 Legal Applicability

These obligations are governed by French law and applicable European Union confidentiality and unfair competition law, and survive indefinitely the termination of any relationship with Santo de Piedra.

 

Limitation of Liability

To the maximum extent permitted by French law:

  • Santo de Piedra shall not be liable for indirect, incidental, consequential, special, punitive, or reputational damages, including loss of profits, loss of opportunity, or loss of data, arising from use of the website or products, even if advised of the possibility of such damages.

  • Santo de Piedra's total aggregate liability for any claim arising from or related to a transaction shall in no event exceed the amount actually paid by the customer for the relevant product through our e-commerce platform.

  • Santo de Piedra shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control (see Section 16, Force Majeure).

Nothing herein excludes or limits liability that cannot be lawfully excluded or limited under French law, including liability for death or personal injury caused by gross negligence or wilful misconduct.

 

Indemnification

You agree to fully indemnify, defend, and hold harmless Santo de Piedra, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • your misuse of the website,

  • your violation of these Terms,

  • your breach of applicable laws or regulations,

  • your infringement of any third-party rights,

  • any transaction conducted by a third party as described in Section 3.2.

 

Privacy & Data Protection

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés). Santo de Piedra implements appropriate technical and organizational measures to protect personal data and processes such data only to the extent necessary for the purposes disclosed at the point of collection.

 

Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed exclusively by French law, without reference to conflict-of-law principles.

Any dispute shall be submitted to the exclusive jurisdiction of the competent courts within the jurisdiction of the Cour d'appel de Paris, notwithstanding plurality of defendants or third-party proceedings, without prejudice to mandatory consumer-protection provisions that may grant consumers the right to bring proceedings in their own place of residence.

 

Severability

If any provision of these Terms is held invalid or unenforceable under applicable law, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect. The parties agree to replace any invalid provision with a valid one that most closely reflects its original intent.

 

Entire Agreement & Non-Waiver

These Terms constitute the entire agreement between you and Santo de Piedra regarding your use of the website, superseding any prior agreements or understandings.

The failure of Santo de Piedra to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

 

Force Majeure

Santo de Piedra shall not be liable for any failure or delay in the performance of its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, acts of government, war, civil unrest, labor disputes, supply chain disruption, epidemic, or failure of third-party carriers or infrastructure.

 

Assignment

Santo de Piedra may assign, transfer, or subcontract its rights and obligations under these Terms, in whole or in part, at its sole discretion and without notice. You may not assign your rights or obligations without the prior written consent of Santo de Piedra.

 

Amendments

We may amend these Terms at any time, at our sole discretion. Amendments take effect upon publication on this website. Continued use of the website following any amendment constitutes acceptance of the revised Terms.
